KUALA LUMPUR: Former Lord President Tun Salleh Abbas and five ex-Supreme Court judges were paid a total of RM10.5mil as ex-gratia payment.

Of the amount, almost half went to Salleh, Minister in the Prime Minister’s Department Datuk Seri Mohamed Nazri Abd Aziz revealed in Parliament yesterday.

The minister also offered a twist to the story. He said the judges were not sacked or suspended.

Instead, they had been receiving monthly pensions of between RM4,815 and RM6,548.59 in the last 20 years following their early retirement.

“The ex-gratia payment is not the Government’s admission of guilt. I wish to clarify that their services were not terminated.

“They have been given pensions for the past 20 years. Does that mean that they were considered guilty?” he said when asked by Wee Choo Keong (PKR – Wangsa Maju) on why the judges were given pensions.

KUALA LUMPUR, Nov 7 — Former de facto Law Minister Datuk Zaid Ibrahim has refuted his successor Datuk Seri Nazri Aziz's claim that the six Supreme Court judges who lost their jobs in the 1988 judicial crisis were not sacked.

"I have only this to say. The judges had been sacked and a miscarriage of justice of the gravest kind has been committed," he told The Malaysian Insider today of the judges who were removed in the fallout from an intense dispute in Umno which saw the party being deregistered.

Yesterday, Nazri, the Minister in the Prime Minister's Department, announced in Parliament that RM10.5 million was paid as ex-gratia to former Lord President Tun Salleh Abas and the five others, explaining that requests from MPs had forced the government to renege on a promise by Prime Minister Datuk Seri Abdullah Badawi to keep the amounts secret.

Stating that "if they were sacked, there would be no pension," Nazri claimed that the judges were not sacked as pensions were paid to and "accepted faithfully" by Salleh, Tan Sri Azmi Kamaruddin, Tan Sri George Edward Seah Kim Seng, Tan Sri Wan Hamzah Mohd Salleh and the families of the late Tan Sri Eusoffe Abdolcadeer and the late Tan Sri Wan Suleiman Pawanteh.

Former Prime Minister Tun Dr Mahathir Mohamad had been portrayed as the villain in the saga considered by the Bar Council to have marked the end of judicial independence, but he has consistently denied the charge by pointing out that the judges had been removed by properly set up tribunals.

Abdullah’s government had announced the decision to pay the judges the ex-gratia sum in his speech at the Bar Council dinner on April 17.

"The government would like to recognise the contributions of these six judges to the nation, their commitment towards upholding justice and to acknowledge the pain and loss they have endured," he had said.

Zaid, then the de facto Law Minister, had initiated the effort which came under criticism from Dr Mahathir and his supporters.

The Malaysian Insider understands that the Cabinet had decided to refer to the monies as "goodwill ex-gratia payments," as stated in Abdullah's April 17 speech, instead of "compensation" as the latter would imply an admission of guilt.

Since his resignation from the Cabinet and Senate, there has been a push by some ministers, including his successor Nazri, to disclose the sum in the name of accountability.

"Any responsible government would do the only right thing and that is to compensate them. That's what I had done and the Prime Minister was right in supporting the decision," Zaid told The Malaysian Insider.

Judges In 1988 Judicial Crisis Sacked, Says Mahathir

PUTRAJAYA, Nov 8 (Bernama) -- Former prime minister Tun Dr Mahathir Mohamad said the three judges involved in the 1988 judicial crisis were sacked and not asked to retire early as stated by Minister in the Prime Minister's Department Datuk Seri Mohamad Nazri Aziz.

"As far as I know, they were sacked," he told reporters when asked to comment on the matter at the Perdana Leadership Foundation, here.

Former Lord President Tun Salleh Abas, the late Tan Sri Wan Suleiman Pawan Teh and Datuk George Edward Seah were dismissed from office after a tribunal found them guilty of misconduct in the 1988 judicial crisis.

Three other judges, Tan Sri Mohd Azmi Kamaruddin, the late Tan Sri Eusoffe Abdoolcader and Tan Sri Wan Hamzah Mohd Salleh, were suspended but subsequently reinstated.

Dr Mahathir said, however, that the former judges still received a pension on compassionate grounds. Dr Mahathir said that despite the fact that he was sacked, Salleh had rendered service to the government in the years when he was there.

"To cut him off completely from his pension is very cruel, so it was decided that he and the other judges get their pensions," he said.

Last Thursday, Nazri said in the Dewan Rakyat that the tribunal had never recommended the sacking of the judges but required them to retire early.

He had earlier revealed in the house that Salleh was paid RM5 million in ex-gratia payment by the government, Seah and the late Wan Suleiman Pawan Teh RM2 million each, and Eusoffe, Wan Hamzah and Azmi RM500,000 each.

Dr Mahathir declined comment when asked whether the ex-gratia payments were sufficient, saying that the question should be posed to former Minister in the Prime Minister's Department and de facto Law Minister Datuk Zaid Ibrahim.

（吉隆坡）負責法律事務的首相署部長拿督再益依布拉欣已在今日（週一，9月15日）下午2時，辭去部長職。

再益的高級私人秘書哈納菲向星洲日報證實這項消息。

他說，再益是於下午約2時，通過部門官員提呈辭職信給首相拿督斯里阿都拉。

根據《星洲日報》記者在首相官邸外觀察，再益於下午3時50分進入首相官邸見阿都拉。至截稿時，還不知道會談結果。

再益依布拉欣於週日（14日）在哥市巴西荷住家的新聞發佈會上，表明不認同政府以內安法令扣留雪州高級行政議員郭素沁、部落客拉惹柏特拉，以及《星洲日報》高級記者陳云清的做法。

他表示，內安法令只應該用來對付恐怖份子，並促請政府釋放郭素沁及拉惹柏特拉。

再益依布拉欣表示，自己隨時準備面對越級行為的後果，即使被要求辭職，他也會堅持原則，繼續對內安法令做出批評。

部分華小督學不配合

（新山15日訊）教育部副部長拿督魏家祥對部分奉行“小拿破崙”作風的華小督學大為光火，並警告他們最好照章行事，別阻礙地球轉動！

魏家祥聲稱，若這些華小督學依然故我不願配合，就請自動退下，回到學校重執教鞭。

他特別把矛頭對准柔州，坦言這個州屬是他接獲最多投訴的地方；他已諭令州教育局主任徹查，並承諾會以“賞罰分明”的方式處理這項問題。

他今午在泰豐華小新校園簽約暨動工儀式后，發表上述談話。

魏家祥以臨教培訓課題舉例說，教育部自有一套處理問題的方式，問題是部分華小督學根本沒有依照指示辦事，導致一些已近“超齡”的臨教，遲至今日仍無法如願進行提升。

“無論督學或其他等級的教育局官員，我希望他們親身瞭解老師面對的問題，並反映出來，然后遵照教育部的指示，而不是用自己那一套做，結果搞出一大堆問題。

“若他們依然故我不願配合，就請他們退下回到學校重執教鞭，總之我會徹查到底，賞罰分明。”

原来不只是马华公会当家不当权，即使是政府也是如此。

工程部长莫哈末再因表示，由于受到特许经营合约束缚，就算大道收费站出现严重塞车问题，服务水平差强人意，政府也无权阻止大道公司继续向使用者收费。

他表示，政府只能指示大道公司改善收费站设施，包括增加收费站柜台、使用多通道自由流动制度（Multi Lane Free Flow），以及鼓励司机使用一触即通卡或精明通行卡（Smart Tag）。

莫哈末再因今早在国会下议院，回答民主行动党蒲种国会议员哥宾星有关白蒲大道经常出现塞车现象的问题时，这么表示。

哥宾星询问莫哈末再因，政府与大道公司签署的合约，是否允许政府在大道持续出现交通问题时，阻止大道公司继续向使用者收费。

开始时莫哈末再因长篇大论解释政府如何受大道合约所限，最后哥宾星按捺不足打岔要求回答其问题，莫哈末再因才回答，“如果要我们指示大道公司不收费，答案是合约里没有规定”。

莫哈末再因承认白蒲大道在繁忙时间出现交通阻塞，收费站的服务“跌到如此低的水平”，但这“纯粹是有待解决的运作问题”，因此马来西亚大道局已经指示白蒲大道公司改善收费站的交通状况。

他强调，政府必须遵守与大道公司签署的合约，不能随意改变，“这是主要的考虑点”。

不过他补充说，若大道合约规定，有关大道的交通流量达致一定水平后就必须分享盈利，那么政府就能够采取适当的行动。但是他没有说明那一条大道的合约带有这项条文。

至于南北大道昨日宣布提供3项优惠给车主，以履行该公司的企业社会责任，莫哈末再因表示，大道合约并没有规定大道公司必须履行企业社会责任，因此政府“不能强迫，只能请求”。

就这样，中学又少了一位华文老师！

2008年10月，我終於呈上辭呈。等了整整4年，從前副教長韓春景，到現任副教長魏家祥，我們都見過，也都盡最大的努力，將我們的心聲傳達，我們希望回到普通中學教華文，那本來屬於我們的地方。

2005年，前副教長韓春景曾經如此承諾，各大報章皆有報導，“那只是特別個案，我們將儘快培訓前往全寄宿中學教華語的教師，短期內將有關教師調回普通中學執教。”2006年，7位中學華文受訓的華文教師被派往全寄宿中學教華文。2007年，5位中學華文受訓的華文教師又被派往全寄宿中學執教。

2008年5月，我們於森美蘭見到剛走馬上任的副教長，將同樣的心聲傳達。5月底，魏副教長的政治秘書致電，說：“ 我們將盡力與有關方面交涉，希望你們耐心等候。”我同時收到首相署職員的電郵，說已將我等的事件呈交於教育部人事處，人事部的官員也給我發電郵，說：“我們的部門正盡力在最短的時間安排教師前往你的學校代替你的職位。”6月的調職，寫給魏副教長請願書的名單中，沒有任何人獲得調職。11月的調職，同樣的沒有任何人獲得調職。我早就預測了這樣的結果，所以在10月提上辭呈。

如我在2006年在全寄宿中學教了7年的一位朋友說：“明年，再也不要回到學校去了。”在全寄宿中學教華語是甚麼滋味，沒有身歷其境的人，說了也只是徒費氣力。我慶幸的是，經歷了三任的校長，每一個都能理解我的處境。在官員們眼中，4年或許很短，可是對於在全寄宿中學執教的華文老師來說卻是非常漫長的日子。

我倒情願那些胡亂許下承諾的官員們，直接潑我們一頭冷水，別給我們任何虛假的希望。

对于我国的治安日愈败坏，我们是感到忧心忡忡的。
前一阵子去吉隆坡开会，马来同事不忘叮咛：“没事就留在酒店好了，不要出门。”
如今，智慧超群的候任首相开口指点迷津，果然如醍醐灌顶，叫人茅塞顿开，惊觉原来一切都是我们这些小民杞人忧天。

马国的治安还是良好的。
日本和香港比起我们要糟多了。
原来，一切只是公众的错误印象而已。

呼！终于松了一口气。
明天去吉隆坡开会，可以安心到处逛了！
